2. Purpose and scope

This Legal Notice governs access to and use of the website basketouch.com (hereinafter, “the Site”), owned by Basketouch Solutions Spain, S.L. (hereinafter, “Basketouch”, “we” or “the Company”).

Basketouch is a software company that develops and markets digital products for coaches and technical staff, including CutSports, CutSports Pro, BasketSets and DrawSports (including the PRO version for teams). Each product may have its own domain, terms of use and complementary specific policies (for example, cutsports.app or drawsports.app).

Accessing the Site implies acceptance of this Legal Notice, the Privacy Policy, the Cookie Policy, the Terms and Conditions and, where applicable, the Refund Policy.

3. Conditions of access and use of the Site

• The user agrees to use the Site lawfully, respectfully and in good faith, without attempting to damage, overload or impair Basketouch's systems.
• Unauthorized access to restricted areas, unauthorized mass extraction of content (scraping) for commercial purposes, and any use that infringes third-party rights or applicable regulations are prohibited.
• Basketouch may temporarily suspend access to the Site for maintenance, security or force majeure reasons, seeking to minimize inconvenience to users.

4. Intellectual and industrial property

Intellectual and industrial property rights over the Site, its design, source code, texts, logos, trademarks (Basketouch, CutSports, DrawSports, BasketSets and their derivatives), images and other content created by Basketouch belong to Basketouch Solutions Spain, S.L. or are used under due authorization.

Reproduction, distribution, public communication, transformation or exploitation of such content without express written authorization from Basketouch is prohibited, except in cases legally permitted.

Videos, projects, diagrams and other content generated by users with Basketouch applications are the responsibility of those users. Basketouch does not claim ownership of content created by the user on the user's device, except as expressly provided in the terms of the relevant product.

5. Links to third-party sites

The Site may include links to Basketouch product domains or to third-party sites (App Store, payment processors, infrastructure providers). Basketouch does not control the content or privacy policies of external sites; accessing them is the user's responsibility, and users should review their terms before using them.

6. Liability

Basketouch does not guarantee the absence of typographical errors or occasional interruptions of the Site. The sports tools marketed by the Company are meant to support technical decision-making; they do not replace the professional judgment of the coach or the sports organization.

To the extent permitted by law, Basketouch will not be liable for indirect damages, lost profits or data loss arising from use of the Site, except in cases of willful misconduct or gross negligence attributable to the Company.

7. Providers and hosting

The Site and part of the Basketouch products' infrastructure rely on providers that act as data processors or sub-processors, as applicable: Vercel (web hosting), Paddle (payment processing for Mac products, where applicable), Apple (distribution and billing for DrawSports on the App Store), Supabase (licenses and accounts, where applicable), Brevo (communications and contact lists, where applicable) and Resend or other transactional email providers. 8. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. For the resolution of any dispute arising from access to the Site, and unless mandatory consumer regulations establish otherwise, the parties submit to the Courts of the owner's domicile (Avilés, Asturias), without prejudice to the jurisdiction that may correspond to the consumer under European Union regulations.
